5/29/06:  IS YOUR LIABILITY RUNNING LOOSE?

An unconfined dog running loose can get into serious trouble! Chasing cars, fighting with other animals, dumping trash, attacking livestock, causing property damage, being shot at or possibly poisoned and may even cause personal injury by biting people.

FACT: Florida Statute 767.01 "Dog owner's liability for damages to persons or domestic animals" Owners of dogs shall be liable for any damages done by their dogs to a person or to any animals included in the definitions of "Domestic animal" and "livestock" as provided by s.585.01.

FACT: Florida Statute 767.04 "Dog owner's liability for damages to person's bitten." The owner of any dog that bites any person… is liable for damages suffered by person bitten.

FACT: Florida Statute 767.13 allows for criminal prosecution of persons "demonstrating a reckless disregard" of an animal's propensities for being dangerous, up to and including third degree felony charges.

FACT: Many homeowner's insurance policies exclude losses incurred by dogs.

Pasco County Code of Ordinances Chapter 14, requires ALL dogs to be kept under "Direct Control" at all times, which means "immediate, continuous physical control…of an animal at all times such as by means of a fence, leash, cord or chain of such strength to restrain the same."

Don't put yourself at risk of becoming entangled in a lawsuit or becoming a defendant in a civil or criminal court action. Keep your dot(s) safely and securely confined on your own property at all times!

In keeping with the above leash law, if you truly love your pet, you will not put them at risk of possible quarantine and euthanasia by ignoring these rules. Stuff you would least expect can happen and does happen.

Not everyone loves your pet as you do. If you are a good neighbor, you will respect your fellow neighbor's right to enjoy our community without the feel of threat from your unrestrained animals. If you are not a good neighbor, become one.

Our common areas and other peoples yards ARE NOT your dog's own personal restroom. If you don't want to clean up after your pet, what makes you think anyone else does???
Pick up your poop!

10/24/05:  Approved 2006 Budget.  The budget below was approved by the Board of Directors in September 2005.  The Budget allows for continued improvements to the community, growth of reserves and no increase in assessments.

9/29/05:  Security Patrol Update/News

The Crime Stats YTD August 2005 summary is on the website for review.

Crime stats were the lowest number of incidents since we established the patrol.

> There have been a couple of incidents that have occurred that should be noted.

1) There was a break in to an automobile on Wild Frontier. Unfortunately, the homeowners had left their automobiles unlocked.

2) There was also a break into a secured tool box in the back of a Pick Up truck on Golden Eagle. Tools were taken from that incident.

> Off duty deputies have been on duty each weekend this month. One shift on a Saturday, evening had two incidents. At 12:00 midnight, 6 juveniles were out on skateboards and bikes. The Deputy took the kids to the home of one of the kids which was on Tradewinds near Austin Range (Cypress Estates). The parents said they were having a sleep over, the deputy said that if they were caught out again they would be charged with the vandalism that occurred in Stagecoach. Another incident occurred at 2:30 AM Sunday Morning of that same patrol. He caught a couple of kids "FORKING" the neighbors lawn. A couple of hundred plastic forks stuck in the lawn, the juveniles were made to pick up the forks and taken to the homeowner and then home to the parents. The other 3 shifts had no incidents to report.

Please contact the Sheriff’s Office if you see traffic violators, criminal behavior or suspicious activity. Continue to call on any of these as they occur. Stagecoach Security Patrol can’t fix these incidents. Constant vigilance on reporting this activity will increase the manpower the Sheriff’s Office assigns to Stagecoach. So keep those calls going into dispatch.

> On Thursday, September 15, 2005, we had a special guest speaker from the American Red Cross at our Security Patrol meeting. The presentation focused on Hurricane Preparedness. The meeting was held in the recreation center at 7:00 PM. Stagecoach there were only 12 attendees for this very important presentation.

The Pasco County Sheriff’s Citizen Academy is starting new classes about every other month. The class meets twice a week for six weeks and you will learn everything you would ever want to know about operation of the Sheriff’s Office. If you are interested please call me for an application. The meetings are held at the Land O Lakes Correction Center.

The Sheriff’s Annual Golf Tournament is October 1, 2005 at Lake Jovita CC the cost is $125. Let me know if you are interested I will get you an entry form.

The Pasco County Security Patrol Association will hold the annual picnic on October 22, 2005. The tickets cost $8 each and this includes a catered lunch and a 2 man country band. Fred Dichter has the tickets.

9/08/05:  Crime in Stagecoach

This past Sunday a car was burglarized in a Stagecoach.  Wallets and cell phone were stolen.  Unfortunately, the door was left unlocked so there was not any forced entry (Note:  Lock your car and don't leave valuables in them!).  The residents were very shocked by this especially because they felt so safe in this neighborhood.  Too safe that they let their guard down by leaving stuff in their unlocked car.   The Sheriff informed them since we are so close to the interstate, the criminals just go up and down the street trying every door. 

9/08/05:  Transport Provided to Anywhere - Room Desperately Needed! (For the Animal Victims of Katrina)

There is transportation provided, with people ready and waiting, for upwards of 200 dogs and 150 cats so far rescued from the devastation of hurricane Katrina. What these animals need is a place to go. Kennels, boarding, vets offices, shelters with any extra space, foster homes and rescues. Even one or two open kennels would greatly help.

From what we know, all animals have been vaccinated and are in good health considering the conditions. There are dogs and cats of every breed and size. Some are in groups of two, three or four, hailing from the same family, while some are solitary ANY KENNEL SPACE AVAILABLE CAN CERTAINLY BE USED. These drivers are willing to move these animals ANYWHERE they need to go. Absolutely anywhere.

The current safe houses for these animals are being inundated and some of these pets will have to be euthanized if they are not moved to make room for the incoming animals.

Please feel free to pass on this information everywhere. Every forum, every list, every community.

REMEMBER THESE ANIMALS WILL BE TRANSPORTED TO YOU.

If you know anyone, anywhere, that is willing to take in even one cat or dog, please have them contact Lynda at the information provided below.

Hurricane Katrina Animal Shelter Relief ~ SEPTEMBER 8 UPDATE
SPCA Tampa Bay volunteers left early this morning headed for Hattiesburg, MS, to deliver supplies and pick up dogs that have been surrendered by their owners in the wake of Hurricane Katrina. Led by Laura Fletcher from Fletchers Harley-Davidson in Clearwater the group will be arriving back at the SPCA Tampa Bay sometime Saturday, September 10th.

The animals that are being transported are only those that have been relinquished by their owners. The other animals will be held at least 30 days after their incoming date. If their owners do not claim them they will then be transported to permanent shelters where they can be put up for adoption.
The first animals to arrive at the Hattiesburg temporary shelter were 53 dogs and 26 cats. The shelter is an agricultural site and has 4 barns with 75 stalls that are being used to house displaced pets. As the animals come in they are tagged, given a physical exam, fed and watered and made as comfortable as possible. More animals arrive every day.

The volunteer team is also caring for 6 horses and rounding up stray farm animals in the area. Hattiesburg is also the location for temporary shelter for people and their pets who have been displaced by the storm.

The Hattiesburg temporary shelter needs hard working volunteers immediately.

SPCA Tampa Bay volunteers must:
o Have completed the general SPCA Tampa Bay volunteer orientation,
o Have experience working with dogs (in a shelter, clinic or kennel),
o Be physically and mentally able to Òrough itÓ (i.e., bring your own tent or self-sufficient vehicle for sleeping, tolerate the heat)
Food will be provided by the American Red Cross.

8/24/05:  2006 Budget Preparation

Fall is on the horizon (you can almost feel the chill in the air, can’t you?) and the Board is beginning preparation for the transition to the new year.  Time to contemplate candidates for upcoming Board positions, potential new members for the various committees as well as the budget for the upcoming year.  From the point of view of the Board Treasurer, my focus is the budget preparation.  I need not remind you that the budget, divided by the 559 property owners, becomes our annual assessment (paid quarterly).

Last year, I began the process of soliciting input from the community at large, in preparation for the process of assembling a draft budget for presentation to the board, ultimately for approval and implementation.  This year we will do the same with starting with providing property owners worksheets containing financial information, including this year’s budget, actual costs to date and projected total annual costs, as well as historical data, and several columns of statistical information.  The intent of these worksheets is to communicate the facts of our expenditures and reserves, in a manageable format, so we can closely examine finances, opportunities to save money and potentially areas that we need to commit more money in order to build an outstanding community.  These worksheets are available both on-line from the community website as well as hard copies may be obtained from the attendants in the community office, during normal business hours.  The culmination of this effort is a meeting, open to the community, where we go through the budget line by line to determine our planned expenditures for the year, our reserve (savings) philosophy and ultimately our proposal for next year’s quarterly assessment.  This year’s meeting is scheduled for September 10th from 3:30-5PM.  Based on the information I’ve prepared and last year’s meeting, I expect the meeting to last approximately 90 minutes

Last year’s meeting was attended by too few people.  The meeting, from feedback I gathered, was received well by the attendees, sighting meaningful information presented in an informative and efficient manner.  This year we could dramatically improve this process with increased participation in the meeting.  Please take the time to obtain documents and actively participate in the 2006 Budget Workshop.  If for some reason you cannot afford the time to attend the meeting, please feel free to e-mail me (bt@ticus.com) any input you have prior to the meeting so your input can be included.  This is the one chance you have to directly affect your own checkbook when it comes to POA dues.  We look forward to your active participation and input.

 

8/24/05: Security Patrol Report

> We have lost more folks in the last 60 days due to relocation, health and personal reasons. We need more volunteers.

1) There was an uninvited individual found swimming in a homeowner’s swimming pool at 3:00 AM one morning. The screen door had been locked but the intruder cut the screen to enter. The backyard was fenced but the gates were not locked. If this occurs on your property call the Sheriff’s Office and report it! To help prevent it if you have a pool and your yard is fenced remember to lock it. It will help to deter an intruder.

2) Two vehicles were paint balled on Austin Range. If you see this type of activity or are a victim of it call the Sheriff’s Office and report it.

8/1/05: CRIMINAL ACTIVITY / TRESPASSING IN STAGECOACH

This was sent in from one of our residents describing an incident which happened in his pool this past weekend:

On 7/28/05 at 3:30 AM I was awaken by a strange man swimming in my pool, what is scary is that I have a fenced in yard and a screened in pool, this person came into my back yard through my fence then cut a hole into my screen to unlock the latch to get into my pool area to go swimming, I have reported this to the Pasco County Sheriff’s office. This incident is very unnerving since we just moved into Stagecoach less that a month ago.

As a follow-up to my earlier message, my pool pump just stopped working therefore requiring me to contact a pool repair service on Saturday 7/30/05, the pool repairman informed me that the wires to my pool motor had been cut and that someone had stuffed some type of object (lord knows what) up into my vacuum system intake opening thus causing it to stop working also, he will have to come back on another service call with a compressor to blow out and clear the lines, so far this issue has costs me $300.00, I contacted the Pasco Sheriff’s office on Saturday who then dispatched an officer, I spoke with the officer at great length, I don’t know what is the issue here, I’m not sure if we have some type of pervert running around on Conestoga drive or just somebody who doesn’t like my pool, considering that I just moved into Stagecoach about a month ago from Pennsylvania and I have had very little time to meet anyone I find it hard to believe that I’ve created enemies already.

It looks like this man has paid several late night visits to my property and I have informed my neighbors to be aware of the problem also because who knows when and where he will strike next because like me several of my neighbors have small children and wives.

The meeting was held in the recreation center at 7:00 PM only about 20 folks from Stagecoach attended all except one were associated with the Security Patrol.

> Central Pasco had been experiencing some suspected gang activity in Wesly Chapel. Graffiti is the big problem on the club houses. The Sheriff’s Office believes they have resolved the issue and the offenders have been arrested tried and are serving time.

> It is vacation time! Don’t forget to take care of your mail and newspapers while you are away. To the criminal element this is an invitation for them to know there is no one home. Also, keep your shrubs and trees trimmed to avoid providing places for burglars to hide and wait.

6/29/05:  Effective June 28, 2005:   The staining of Driveways is approved.  You still must get ACC Approval, and the only authorized COLOR/BRAND is BEHR #819 Catalina Stone (Solid Color Concrete Stain - Siliconized 100% Acrylic), which is available at Home Depot.  Brochures for this product are available in the Clubhouse for review.

6/28/05:  Effective June 1, 2005:

PROPERTY OWNERS ASSOCIATION, INC.

The Board of Directors voted on 5/23/05 to amend our collections, late fee, recreation center card access suspension rules & legal collections policy. 

Effective 1 June 2005 the policy is amended as follows:
 

Late fees are generated after the 15th of each Quarter if assessment is not paid on time.  Late fees will accrue QUARTERLY on unpaid assessments only. 
 

Late fees will not accrue for late fees only, but rather only for late assessments.  Late fees alone may not generate another Late fee.
 

If payment of the assessment is not received within 60 days of the late due date (1 Jan, 1 April, 1 July, 1 Oct) the account shall be referred automatically to the attorney for Lien.  A notification letter (final 10 day demand letter) shall be sent to the resident advising them to pay the amount in full, or a lien will be placed on their home at least 14 days prior to the 60 day period indicated above by the management company.
 

All legal costs shall be borne by the Homeowner and paid directly to the attorney through settlement with the attorney.  The attorney shall send the association a check for the overdue assessments and any recovered late fees after settlement & collection is complete.  If a legal case is deemed unrecoverable, the association must reimburse the attorney for appropriate fees.
 

The association shall temporarily suspend clubhouse access cards (to include clubhouse, media center, restrooms, fitness facility, children’s playground and pool use) at the time of lien filing and shall not be re-activated until the lien is fully satisfied.
 

The association shall temporarily suspend clubhouse access cards (to include clubhouse, media center, restrooms, fitness facility, children’s playground and pool use) for any actions resulting in the assessment of a fine, until such fine is paid in full by the resident.
 

The association grants the attorney free reign to waive late fees as appropriate to obtain settlement, but at no point shall any Assessments ever be waived.
 

The association grants the attorney, management company and POA leverage to work with past due accounts & late charges as needed to attempt to bring closure & compliance with payment of assessments  prior to implementing liens or other legal actions.

1/13/05:  Annual Meeting

Welcome to our new board members: Anne Cameron Mary Cluck and Robert Carpenter!!  We looking forward to a productive year serving the Stagecoach community. A Big thank you for all the "volunteers" who went door to door obtaining proxy signatures allowing us to conduct our annual meeting.  This eliminated re-mailing proxies, and wasting association funds. 

11/23/04:

10/27/04:

The Board of Directors modified the Fining/Hearing policy to streamline the process, eliminate redundancy, eliminate compounding/timeline fines and increase initial fines.  The goal of the association is to resolve all violations within the two letter, and refer to the attorney/assess fines only as a last resort.

The new policy is:

STAGECOACH PROPERTY OWNERS ASSOCIATION
FINING & HEARING POLICY

This policy is part of the Rules and Regulations of Stagecoach Property Owners Association Inc. (the “Association”), and addresses the procedure for fining owners, tenants, guests and other persons who violate the Declaration, the Articles of Incorporation, the By-Laws, or Rules and Regulations of the Association.

 

Fines are an alternative to other means of enforcement provided for in the Declaration and By-Laws.   Fines have been adopted by the Board of Directors in accordance with the following stated procedures:

 

1.         The Board of Directors or its appointed agents are charged with determining whether there is probable cause that any of the provisions of the Declaration, the Articles, the By-Laws, or the Rules and Regulations of the Association regarding the use of the lot, common areas, or Association property are being or have been violated.

 

2.         The Board of Directors shall appoint a Fining Review Committee (the “Committee”) of three (3) persons, which shall consist entirely of lot owners other than members of the Board of Directors, or persons related to Board members, and which shall be charged with conducting the hearing and rendering the decision with regard to the levy of fines as herein provided Alternate members of the Committee may be appointed, to be available to serve if a Committee member resigns or is unavailable for a hearing.
 

3.         In the event that the Association receives a complaint, or a violation is otherwise determined to have occurred, the Board of Directors (the “Board”) or its agents will notify the alleged violator(s), and in appropriate cases, will provide an opportunity for such violation to be corrected within a reasonable time.  Notification to the alleged violators will include a definitive time period for corrective action to be completed, and shall require written notice by the alleged violator that the discrepancy has been corrected.  Additionally, the letter shall state if the violation is not corrected, a fine will be imposed along with legal fees.

 

4.         If the violation has not been corrected, or in the case of a second violation, or in the case of a violation of such a serious nature that the Board determines it does not warrant an opportunity for the alleged violator to correct it, the Board may adopt a proposed fine, up to the maximum amount allowed by law. A fine may be imposed based upon each day that a continuing violation continues. The fine will not become final until a hearing has been held, or waived by the alleged violator in writing.

 

5.         Following the adoption of a proposed fine, the alleged violator shall be notified by regular and certified mail by the association attorney, along with a notice that the alleged violator may request a hearing before the Committee within fourteen (14) days of the date of the violation letter. Alternatively, the Committee may set the date and time of the proposed hearing before sending the letter to the alleged violator, provided that the hearing is at least fourteen (14) days from the date of the notice. The notice to the alleged violator shall also include a short and plain statement of the matters asserted by the Association, as well as a statement of the provisions of the Declaration, Articles, By-Laws, or Rules, which have allegedly been violated. Failure to request a hearing within this fourteen (14) day period shall constitute a waiver of the right to a hearing.
 

6.         The Committee shall hold a hearing if requested, after giving the lot owner fourteen (14) days written notice of the date, time and place of the hearing, unless the alleged violator waives this fourteen (14) day notice requirement. The Committee may overrule or modify the fine following the hearing, however they may not waive or reduce the imposed legal fees.
 

7.         If the Board has not directly appointed a Chairman, or if the Chairman is absent, the Committee shall appoint a Chairman, and shall conduct hearings in accordance with the following rules, in addition to such other rules and procedures as may be established by the Committee, to hear any charges and defenses. The hearing may be audio or video-recorded in the same manner and tinder the same rules that lot owners are permitted to audio or video-record meetings of the Board.
 

(a)        A representative of the Association shall be heard first, in order to summarize the basis for the proposed fine, and to present any witnesses or documents in support of the proposed fine. Written affidavits shall be permitted, and the hearing need not be conducted according to technical rules relating to evidence and witnesses. A party or witness may also be allowed to appear, provided that the cost involved (if applicable) is paid by the party offering such evidence. Any relevant evidence shall be admitted if it is the sort of evidence on which responsible persons are accustomed to rely in the conduct of serious affairs, regardless of the existence of any common law or statutory rule, which might make improper the admission of such evidence over objection in civil actions. The rules and privileges relating to court proceedings shall only be effective to the extent that they axe required by law to be recognized at the hearing, and irrelevant and unduly repetitious evidence shall be excluded.
 

(b)        Each party shall have these rights: to be represented by counsel; to call and examine witnesses; to introduce exhibits; to cross-examine opposing witnesses on any matter relevant to the issues even though that matter was not covered in the direct examination; to impeach any witness regardless of which party first called him to testify; and to rebut the evidence against him.
 

(c)        Neither the accusing person nor the allegedly defaulting lot owner must be in attendance at the hearing. The hearing shall be open to attendance by all lot owners. In rendering a decision, official notice may be taken at any time of any generally accepted matter within the Declaration, the Articles, the By-Laws, the Rules and Regulations, or the workings of the Association.
 

(d)        Either immediately following the conclusion of the hearing, or within ten (10) days, the Committee shall render a decision on the matter, and will prepare a written summary of the decision, which is to be provided to the Association.  The Association will then inform the alleged violator in writing.  If the decision of the Committee is to uphold the fine, or to impose a reduced fine, the fine shall be payable to the Association within twenty (20) days from the date that written notice of the decision is sent to the alleged violator(s).
 

8.         Subsequent to the hearing, or if no hearing is requested within fourteen (14) days from the date of the letter notifying the violator of the fine, any further enforcement action will be taken by the Board.
 

9.         Any violator(s) will be responsible for interest, costs and attorneys’ fees incurred in the enforcement of the fine, including costs and attorney’s fees in connection with any correspondence or hearings, provided that the Committee upholds the fine, in whole or in part.  Any unpaid fines or legal fees  shall result in suspension of use rights to the Recreational Center, Pool & Fitness Center facility.

 

STAGECOACH PROPERTY OWNERS ASSOCIATION
DEED RESTRICTION HEARING COMMITTEE POLICY & PROCEDURES

 

This policy is part of the Rules and Regulations of Stagecoach Property Owners Association Inc. (the “Association”), and addresses the procedure for fining owners, tenants, guests and other persons who violate the Declaration, the Articles of Incorporation, the By-Laws, or Rules and Regulations of the Association.
 

The committee shall meet on the first Monday of the month if there is business to conduct.  Prior to implementation all rules, regulations, enforcement policy and the fining schedule shall be sent to all residents of Stagecoach as well as article XII and XIII section 12 amendment. 
 

Weekly enforcement shall be carried out through the Management Company in accordance with the terms of their contract for neighborhood patrols.   Residents may participate by sending e-mail or phone calls reporting any deed restriction violations.  All reported violations shall be validated by Melrose Management prior to issuance of a notice of violation.
 

The Management company shall send the Deed Restriction Hearing Committee Chairperson and Board of Directors a copy of all notice of violation letters on a monthly basis, as well as any subsequent of follow-up correspondence. 
 

FINE LIMITS:

General Deed Restriction Violation: To include the following violations-Signage, Pets, Vehicles illegally parked (including boats and RV’s) past time allowed, Commercial Overnight Vehicles, Garbage cans, Outside tanks, Exposed Water Conditioners, Improper lawn care or other related violations.   The First letter will be a warning.  The second letter shall be a final warning, and the third letter, if required, shall be sent from the association attorney and shall assess a fine of $150, plus specified legal fees.  Subsequent violations shall results in subsequent fines and legal fees.
 

Architectural Control Violation:  To be used in the event of architectural violations.   The First letter will be a warning.  The second letter shall be a final warning, and the third letter, if required, shall be sent from the association attorney and shall assess a fine of $500, plus specified legal fees.  Subsequent violations shall results in subsequent fines and legal fees.

As you know, In mid-September we held and open Budget Meeting for residents to discuss budget issues, as well as have direct input into the budget development, execution and impact on Assessments.  The Board of Directors approved the FY05 Budget at the September Board Meeting.  I will post our approved budget and spreadsheet, but wanted to get the word out in advance that effective January 1, 2005 our quarterly assessments will be raised from $130 per quarter to $155 per quarter.   Mr. Brian Troutman did a superior job documenting expense trends and developing a budget solution which would both ensure fiscal health, as well as provide long-term financial resources to cover high dollar purchases or repairs (pool, roof, berms, etc.).  I will post the documents shortly, however if you have specific question, you can contact me at bruce@stagecoachfl.org or Brian at bt@tiscus.com.

The Presidents page has been updated and our Newsletter will be mailed on 2/28/04.

Last week a fire was set in one of the restrooms in the clubhouse. This occurred after the attendant was off duty. While we have a scan of the last person to enter the clubhouse door, we did not have video to prosecute. That will change this week when we updrade to a high quality, all digital color security system. This system will also include additional areas of coverage including our front entrance. We will prosecute anyone caught breaking the law. Additionally, as an added protection measure the board is considering scan card stations at each restroom (similar to how you swipe in and out of the clubhouse, gym, etc..) to provide 24/7 video and scan id of each person entering the spaces. THis will provide additional evidence to prosecute. The cost for this, and to upgrade our current winpak scan software/computer is around $5000. The Board would like your input on whether you feel this is necessary and justified to protect Stagecoach, the Clubhouse and your investment. Sorry for no updates in a while....I have been extremely busy with work and Stagecoach issues.

Important:  Friday night we had a fire set in the Men's restroom at the clubhouse.  Effectively immediately the restrooms will be locked when an attendant is NOT on duty.  This means during our summer hours they will be locked from PM until 11AM the following day.  Sorry for the inconvenience, but we could have lost the entire building that night. 

Security System - As you know, we have one.  We need to expand immediately to provide coverage to our vulnerable areas.  This would have captured our vandals at the Rec Center and in our parking lot where we had more vandalism last week.

If you feel this video surveillance system is critical to our security/safety, please let your board members know so they can vote your concerns.

The Board Meeting is tomorrow night (2/23) at 6:30PM.

On 23DEC03 the Board of Directors held an emergency attorney/client meeting.  The results of this meeting were the Board unanimously voted to dismiss a pending lawsuit.  A provision of dropping this suit was that the public document (Plaintiff's Notice of Voluntary Dismissal without Prejudice - Pasco County Circuit Court - Circuit Civil Division Case No. 51-2002-CA-001936ES) would be posted and available for Stagecoach Residents to view.  This document explains the decision for the 2002 Board of Directors to file a lawsuit and the circumstances and parties involved with the decision to drop this suit.  The document is below for your review, and will be posted at the Recreation Center.  You will need Adobe Acrobat to view this document.

Neighboring communities define borders

The fuzzy border between Land O'Lakes and Wesley Chapel is coming into focus.

Representatives of both communities' chambers of commerce have tentatively agreed to shared boundaries on State Road 56 and County Road 54.

If those lines are publicly accepted, Land O'Lakes would begin west of the SR 56-Interstate 75 interchange and Wesley Chapel east of the interstate.

But on CR 54, Wesley Chapel would begin far west of the interstate, taking in neighborhoods such as Stagecoach that have a Land O'Lakes' ZIP code and mailing address.

With the opening last year of SR 56, State Road 54 was downgraded to County Road 54 east of I-75. It also got a new name: Wesley Chapel Boulevard.

Local business leaders recognize that SR 56 is the most convenient route to Land O'Lakes, said Tim Hayes of the Central Pasco Chamber of Commerce, based in Land O'Lakes.

"We feel the SR 56 entranceway off I-75 is the natural entranceway for Land O'Lakes," Hayes said.

Border discussions recently arose with the compilation of a Land O'Lakes "vision plan" that suggested, for planning purposes, a Greater Land O'Lakes that stretched to I-75.

Wesley Chapel had its own lines that didn't necessarily correspond to those of Land O'Lakes. Representatives from both chambers called a meeting this month. They appear to have settled any differences.

"We know what our borders are," Wesley Chapel chamber spokeswoman Alison Morano said.

Wesley Chapel's chamber staked out border signs on SR 54 a few years back that raised eyebrows. Zephyrhills questioned the marker near Morris Bridge Road. Land O'Lakes business people joked about how Wesley Chapel seemed to be creeping west.

Land O'Lakes commissioned hand-painted signs with a heron and lake logo, Hayes said, but mothballed them over questions of where to place them.

Of course, borders aren't formal for the simple reason that neither community is a real city with taxing boundaries. But Morano said defining boundaries helps build unity. "If you outline the border, you know where you are, and you can evolve into a community," she said.

Street Flooding Prompts Lawsuit

LAND O' LAKES - Serena Micech and her family moved into The Enclave two years ago, drawn by the amount of house they could get for their money. What they didn't expect was the amount of water they'd find in the streets.

Flooding on Ravello Street has prompted regional water management officials to sue the developer, Trimar Southeast Developments Inc. of Clearwater, to force the company to fix drainage problems in the subdivision.

The Southwest Florida Water Management District, known as Swiftmud, says Trimar has refused to repair The Enclave's faulty stormwater drainage system, despite agreeing in February to do the work.

Trimar's attorney, Donna Feldman of Clearwater, could not be reached for comment Friday.

According to the consent decree between Trimar and Swiftmud, filed last March in Pasco County, the developer agreed to pay $10,500 in fines and repair a variety of problems at the site.

At the top of the list are flooding on Ravello near Anne Jolley Court and a poorly built retention wall between The Enclave and Stagecoach subdivision to the east. Storm runoff is seeping under the retention wall, flooding property in The Enclave and threatening to cause the wall to collapse, according to Swiftmud.

Also on the list of mandated but undone repairs are: improperly graded lots in the first phase of the project, incorrectly built ponds, drain inlets and control structures in those ponds, clogged drains and poorly draining outfalls.

``They paid the fines, but they didn't fix what needed to be fixed,'' said Swiftmud spokesman Michael Molligan.

Trimar previously owned a dirt mine on the land where The Enclave sits. The mining permit expired in 1995, and Trimar began developing the site three years later. In 2001, Maronda Homes bought The Enclave for just over $1 million and began selling lots for single-family homes.

Since then, water has been a perpetual problem for residents of Ravello Street. Even days after a rain, water stands in the throats of the storm drains on both sides of Micech's home.

``There's never a day that there's not water standing in those drains,'' said Harry Younkin, a retired engineer and Ravello resident who has studied the drainage problems. ``It should have never been permitted.''

After a heavy rain, the street can flood several feet deep, say residents.

``You could ride a Jet Ski,'' said Eugene Montesant.

Neighbors say the standing water poses a health hazard because of mosquitoes that breed there, not to mention snakes and rodents that climb up through the drains.

``No one knew that our street was going to be like this,'' Micech said.
